How is marketing automation different from email automation?
Email automation is one channel inside marketing automation. The broader version decides which channel each message goes through and keeps one record of the customer across all of them, so a customer who replied on WhatsApp does not keep receiving the nurture email. The email flows themselves, with examples per type of business, are in email automation for small business.
Two things change once you add channels beyond email. The first is cost: SMS and WhatsApp business messages are charged per message, and WhatsApp prices depend on the message category and the recipient's country, as explained in WhatsApp Business API pricing. The second is that one opt-out has to apply everywhere: a customer who asked to stop receiving SMS should not start getting the same offer by email the next day.
What do Israel and the US require before you send?
This section is a technical description of the official texts, not legal advice. For a decision about your own list or messages, consult a lawyer.
Israel - section 30A of the Communications Law (Telecommunications and Broadcasts), 1982. The section defines an advertising message ("דבר פרסומת") as, among other things, a message distributed commercially whose purpose is to encourage buying a product or service or spending money in another way. Its main provisions, as they appear in the law text:
- An advertiser may not send an advertising message by fax, automatic dialing system, electronic message or SMS without the recipient's explicit prior consent, in writing, which can include an electronic message or a recorded call.
- A one-time approach to a recipient that is a business, offering it to consent to receive advertising, is not a violation.
- An exception applies when the recipient gave their details during a purchase or a negotiation, was told the details would be used for advertising, was given a chance to refuse and did not, and the message concerns a similar product or service.
- The recipient may refuse at any time, free of charge, in writing or through the channel the message arrived by.
- The message must state that it is an advertisement - the word "פרסומת" at the beginning, and in an electronic message in the subject line - together with the advertiser's name, address and contact details and a way to refuse.
United States - the CAN-SPAM Act. The FTC's compliance guide says the law covers all commercial email, with no exception for business-to-business email, and that each separate email in violation is subject to penalties of up to $53,088. Its main requirements:
- Header information (From, To, Reply-To and routing) must be accurate, and the subject line must not be deceptive.
- The message must be identified as an advertisement and include a valid physical postal address.
- It must explain clearly how to opt out, the opt-out mechanism must work for at least 30 days after sending, and requests must be honored within 10 business days.
- Opted-out addresses cannot be sold or transferred, and you remain responsible for what a company sending on your behalf does.
The difference that matters when you build the automation: the Israeli text is built around consent before the first advertising message, while the FTC's list of main requirements is built around identifying the message and opting out. A system that serves both countries therefore stores the consent record and the recipient's country on every contact.
